Disclaimer and limitations of the report
Read this before you order. It sets out what a Scrutinex report is, what it is not, and what you may and may not rely on it for.

01Not a consumer report
Scrutinex reports are commercial due diligence products. They are not consumer reports as defined by the United States Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) or equivalent consumer credit and background screening legislation in other jurisdictions. Cardinal Point Advisors is not a consumer reporting agency.
Reports contain no criminal record data and no credit data. You may not use a report, in whole or in part, as a factor in establishing an individual's eligibility for employment, promotion, reassignment or retention; for the rental or sale of residential property; for credit, loans or insurance; or for any other purpose defined as a permissible purpose under consumer reporting law.
Ordering a report requires you to state your purpose. Orders that fall into these categories are declined and refunded.
02Not legal, financial or investment advice
A report is factual research and professional assessment. It does not constitute legal advice, financial advice, investment advice, tax advice or a recommendation to enter into or refrain from any transaction. No attorney-client, fiduciary or advisory relationship is created by ordering or receiving a report. Decisions taken on the basis of a report are yours, and you should take independent professional advice where the transaction warrants it.
03Sources, currency and completeness
Reports are prepared from public records, licensed commercial databases, and information supplied by you. Every source consulted is listed in the report with the date it was checked. Findings are accurate as at those dates only. Registries, sanctions lists and media records change; a report is a snapshot, not a monitoring service.
Public record coverage varies by jurisdiction. Some registries are not digitised, not searchable by officer, fee-gated, or not public at all. Where a check could not be completed, the report says so explicitly rather than implying a negative result. An absence of adverse findings is not a guarantee that no adverse facts exist.
We do not independently audit information supplied by you or by third-party databases, and we are not responsible for errors originating in those sources.
04Methods we do not use
We work only from lawful sources. We do not use pretexting or misrepresentation to obtain information, do not access private accounts, communications or devices, do not conduct surveillance, and do not obtain data in breach of applicable data protection law. We decline instructions that would require any of these.
05Confidentiality
Reports are prepared for the named client and the stated purpose. We do not disclose to the subject that a report has been commissioned, except where reference verification with contacts you have supplied necessarily involves contacting those individuals, or where disclosure is required by law. You may share the report with your own professional advisors. You may not republish, resell or distribute it publicly without our written consent.
06Limitation of liability
To the maximum extent permitted by law, the total aggregate liability of Cardinal Point Advisors and its personnel in respect of any report, arising in contract, tort (including negligence), or otherwise, is limited to the fee paid for that report.
We are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profit, revenue, business, goodwill, opportunity or anticipated savings, however arising.
Nothing in this disclaimer excludes or limits liability for fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded.
07Your responsibilities
You are responsible for the accuracy of the identifiers you supply, for having a legitimate business purpose for the report, and for complying with applicable data protection and anti-discrimination law in your use of it. Where the subject of an Individual Report is located in a jurisdiction with data protection legislation such as the GDPR, you remain responsible for the lawful basis of your own processing of the report's contents.
