Terms of service

These terms govern your use of the Scrutinex website and the purchase of due diligence reports from Cardinal Point Advisors.

  1. 01The service

    Scrutinex prepares written due diligence reports on companies and individuals from public records, licensed databases and information you supply. Report types, coverage and prices are described on the report types page and form part of these terms.

  2. 02Orders and acceptance

    Submitting an order is an offer to purchase. A contract forms when we confirm we have accepted the order. We may decline any order, including where the stated purpose falls within consumer reporting law, where the identifiers supplied are insufficient to identify a subject, where the request would require unlawful methods, or where the subject or jurisdiction is subject to sanctions restrictions that prevent us from acting.

    You confirm that you have a legitimate business purpose for the report and that the information you supply is accurate to the best of your knowledge.

  3. 03Permitted use of the report

    Reports are licensed to you for the stated purpose and for internal use, including sharing with your own professional advisors. You may not resell, republish, or distribute a report publicly, or use it as the basis of a competing service.

    You may not use a report for employment, tenancy, credit or insurance decisions. See the disclaimer, which forms part of these terms.

  4. 04Fees and payment

    Prices are stated in United States dollars and are payable per report. There is no subscription, minimum order or recurring charge. Prices exclude any taxes or duties applicable in your jurisdiction, which are your responsibility. We may change prices for future orders at any time; the price shown at the time of your order applies to that order.

  5. 05Delivery

    Standard reports are ordinarily delivered within 2 business days of accepted order and Full reports within 5. Where a jurisdiction or a specific check will take longer, we tell you before commencing work and you may cancel for a full refund at that point. Delivery timeframes are targets, not guarantees.

  6. 06Refunds

    You may cancel for a full refund at any time before research begins. Once research has begun the fee is non-refundable, because the cost is in the work rather than the document. If a report cannot be completed because the necessary records are unavailable in the relevant jurisdiction, we refund in full or, at your option, deliver a partial report with a proportionate refund.

  7. 07Intellectual property

    We retain copyright in the report as a work of authorship, together with our methodology, templates and research materials. You receive a perpetual, non-exclusive licence to use the report for the purposes permitted above.

  8. 08Warranties and liability

    We warrant that reports are prepared with the reasonable care and skill of a competent professional in this field. We do not warrant that any report is exhaustive or that public records are accurate or complete. Our liability is limited as set out in the disclaimer, to the fee paid for the report in question, and excludes indirect and consequential loss, save for liability that cannot lawfully be excluded.

  9. 09Confidentiality

    Each party will keep the other's confidential information confidential. We treat the existence and contents of your order as confidential and will not disclose it to the subject or to third parties except as described in the privacy policy or as required by law.

  10. 10Governing law and changes

    These terms are governed by the laws of the jurisdiction in which Cardinal Point Advisors is established, and the courts of that jurisdiction have exclusive jurisdiction over disputes, without prejudice to mandatory consumer protections available to you locally.

    We may update these terms. The version in force at the time of your order governs that order, and the current version is always published on this page with its effective date.
